WiseFinder Privacy Policy

This privacy policy governs your use of the website http://mywisefinder.com and a software application ("Application") on a mobile device that was created by Soluwise, Inc. The Application, WiseFinder, allows you to find and keep track of your friends and family through an easy to use interface while providing the functionality to manage friends and invite contacts from Facebook and your own mobile device.

General
The website (http://mywisefinder.com) and the Application, WiseFinder, are owned and maintained by Soluwise, Inc.

What information does the Application obtain and how is it used?
User Provided Information – The Application obtains the information you provide when you download and register the Application. Registration with us is mandatory in order to be able to use the basic features of WiseFinder.

When you register with us and use WiseFinder, you provide: (a) your name, email address, username and password registration information; (b) your latest position coordinates for friends and family to find and track you.

Data that is collected on http://www.mywisefinder.com is personally identifiable information (name and email), and will never be shared with anyone outside of Soluwise, Inc. without your written consent. Temporary session information may be stored in your computer using “cookies” while browsing http://mywisefinder.com and its related pages. The session information is used to customize the website experience to the user that is logging in. It can also be used to help remember the credentials you logged in with if you wanted to avoid having to type in your username and password again. Once the user logs out of the website, the session information will be deleted. We may also use the email you provided us to contact you from time to time to provide you with important information, required notices and marketing promotions.

Automatically Collected Information - In addition, the Application may collect certain information automatically, such as the type of mobile device and mobile operating system you are using WiseFinder from, your mobile device’s unique device ID to route push notifications accordingly, your latest position coordinates for friends and family to find and track you, and information about the way you use the Application.

Your mobile device's unique device ID will be used to route push notifications corresponding to your account, to your own device. Your device ID is registered with your account when you first log in. If you want to associate your device ID to another account, you must relaunch WiseFinder. Be aware, if you log in to your WiseFinder account on a friend's device, you may cause your push notifications to be routed to your friend's device and not your own. You may have to log in to your device again to route your notifications back again to your own mobile device.

WiseFinder gives the user access to their mobile device’s contacts and Facebook friends from within the Application. Access to the user’s Facebook account and friends list is only obtained through the user’s consent by logging into Facebook from WiseFinder’s Profile tab. Access to the user’s mobile contacts and Facebook friends list is provided solely to allow the user to invite their own friends and let them know about WiseFinder.

WiseFinder does not collect, store or make any use of the user’s mobile contacts and Facebook friends list. Users can Logout from Facebook from within WiseFinder’s Profile tab to block access to the user’s Facebook account and contacts.

Does the Application collect precise real time location information of the device?
This application does collect precise information about the location of your device. It can be done both manually and automatically by logging in to your WiseFinder account. Under the Profile tab, the user can manually update their position. Once logged in, the app will update the user’s position automatically in the background every 8 minutes. In Windows Phone 7, WiseFinder tries to cache the user's position every 15 minutes and if possible, will update that position every 30 minutes. If the user wishes to stop being tracked, the user may log out from WiseFinder at the Profile tab to do so.

We use your location information to allow only people on your WiseFriends list to track and find you. This can be done from both the Application and the website http://mywisefinder.com. We also only store your latest position and do not keep a history of your locations.

You may at any time opt-out from further allowing us to update your location data by logging out from WiseFinder at the Profile tab. For more information, please see the section below entitled “opt-out rights.”

Do third parties see and/or have access to information obtained by the Application?
Yes. We will share your information with third parties only in the ways that are described in this privacy statement.

The website http://mywisefinder.com makes use of the Google Maps API to integrate the Maps implementation in the web version of WiseFinder. As such, users of http://mywisefinder.com agree to be bound by Google’s Terms of Use (http://code.google.com/apis/maps/terms.html) and agree to Google’s Privacy Policy (http://www.google.com/privacy.html).

WiseFinder for Windows Phone 7 makes use of Microsoft's Bing Maps and as such, by using the Windows Phone version of WiseFinder, you agree to be bound by Microsoft's Terms of Use (http://www.microsoft.com/maps/product/terms.html) and agree to their privacy policy (http://privacy.microsoft.com).

We may disclose User Provided and Automatically Collected Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;

  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

  • if Soluwise, Inc. is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site (http://mywisefinder.com) of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

Automatic Data Collection and Advertising
We may choose to integrate analytics to help us understand how the Application is being used, such as the frequency and duration of usage. We may also choose to integrate advertisement within the Application and provide data on how users interact with advertising provided in the Application.

What are my opt-out rights?
There are multiple opt-out options for users of this Application:

Opt-out of all information collection by uninstalling the Application – You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

You may at any time opt-out from further allowing us to have access to your location data by logging out from WiseFinder at the Profile tab or by blocking Location Services access to WiseFinder under your device’s configuration options.

Data Retention Policy, Managing Your Information
We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us at support@mywisefinder.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

Children
We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at support@mywisefinder.com. We will delete such information from our files within a reasonable time.

Security
We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches. We respect your privacy and strive to protect the information provided by our subscribers.

Limitation of Liability
The majority of the data available on the website http://mywisefinder.com and WiseFinder originates from Soluwise, Inc and the users of WiseFinder. Causes such as weather phenomenon, human error, emergencies, Acts of God, Internet congestion, telecommunications breakdown, etc. may render this website and WiseFinder unavailable or cause our equipment and servers to malfunction. Any data and information provided through WiseFinder and the website http://mywisefinder.com is provided without warranty of any kind as to accuracy or timeliness. Soluwise, Inc. cannot be held liable for damages caused by the use of data obtained through the Application, WiseFinder, and its website http://mywisefinder.com. We cannot be held liable for users logging in to WiseFinder from devices that do not belong to the user and causing their notifications to arrive on other devices, or users granting access to or befriending people they do not know or who may cause harm or take some negative action upon the user.

Internet and Computer Crimes
No person(s) shall knowingly gain unauthorized access to, or otherwise use the WiseFinder and Soluwise, Inc. "computer network" (physical wired and/or wireless computer network) and/or "servers" (web, email, DNS, etc.) for illegal purposes, such as cracking, hacking, spamming and, tracking people you are not familiar with. Illegal activity done onto or over our network can and will be prosecuted to the fullest extent of the law.

Changes
This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here: http://mywisefinder.com/privacy.html, and informing you via email. You are advised to consult this Privacy Policy regularly for any changes.

Your Consent
By using the Services, you are consenting to our processing of User Provided and Automatically Collection information as set forth in this Privacy Policy now and as amended by us. "Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the U.S. your information will be transferred to the U.S., and processed and stored there under U.S. privacy standards. By using the Application and providing information to us, you consent to such transfer to, and processing in, the US.
